Terms of Service

These Terms of Service ("Terms") govern your use of byposa.com ("the Site") and any purchase you make through it. The Site is operated by Posa. By using the Site or placing an order you agree to these Terms.
1. Who can buy
You must be at least 18 years old and able to enter a binding contract in your country of residence. We reserve the right to refuse service at our discretion, for example if we suspect fraud, illegal activity, or a breach of these Terms.
2. Product information
We describe the product (material, dimensions, weight capacity, colour) as accurately as possible. Minor variations in natural bamboo grain and tone are part of the product's character and are not considered defects. Images are representative; colour rendering depends on your screen.
3. Orders and pricing
- Prices are shown in Euros (€) and include applicable taxes where the destination requires them.
- Shipping costs, if any, are shown at checkout.
- An order is considered accepted when we send an order confirmation by email. We may cancel an order if an item is unavailable, the price was listed in error, or we suspect fraud — in which case any payment is refunded in full.
- Stock is limited. Availability shown at the time of order is not guaranteed until the order is accepted.
4. Payment
We accept the payment methods displayed at checkout (including Shopify Payments, PayPal, Apple Pay and Shop Pay). Payment is processed by the provider you choose; we never see or store full card details.
5. Shipping and delivery
See our Shipping policy for regions, delivery times and costs. Risk of loss and title to the product transfer to you on delivery.
6. Returns and refunds
You may return the product within 30 days of receipt under the conditions described in our Returns policy. This is in addition to any statutory withdrawal right you may have under EU consumer law.
7. Warranty (5 years)
We warrant that the product will be free from manufacturing defects and materially match the description for a period of five (5) years from delivery. This is our voluntary commercial warranty and extends well beyond the two-year statutory EU minimum — because if the stool fails inside five years we regard that as a product we need to replace or refund, not a dispute.
Covered: manufacturing defects, structural failure (visible wobble, split or crack in the bamboo, broken joinery), and finish failure (sealant peeling, discolouration not caused by cleaning products).
Not covered: normal wear, accidental damage, damage from bleach or abrasive cleaners, and damage from loads beyond the 150 kg capacity.
To make a warranty claim, email email@byposa.com with your order number and photos of the issue. Our statutory obligations under EU Directive 2019/771 are not affected by this warranty.
8. Intellectual property
All content on the Site — including text, images, illustrations, logos and the site design — is owned by Posa or its licensors and is protected by copyright and trademark law. You may not copy, reproduce or use any part of the Site for commercial purposes without our prior written permission.
9. Your content
If you submit a review, comment or other content through the Site, you grant Posa a non-exclusive, royalty-free licence to display and use it in connection with the Site and our marketing. You keep ownership of what you create. Do not submit content that is unlawful, defamatory, or infringes another person's rights.
10. Liability
To the extent permitted by law, Posa's total liability for any claim arising out of or in connection with your use of the Site or a product purchase is limited to the amount you paid for the product. We are not liable for indirect, consequential, or incidental losses. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for any matter that by law cannot be limited.
11. No medical claim
The product is designed to support natural posture. It is not a medical device, is not intended to diagnose, treat or cure any condition, and does not replace medical advice. If you have a specific medical concern, consult a qualified healthcare professional.
12. Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, supply-chain disruption, or acts of government.
13. Governing law
These Terms are governed by the laws of the country where Posa is registered, without regard to conflict-of-law principles. If you are a consumer resident in the EU, you keep the benefit of mandatory consumer-protection rules of your country. Disputes will be resolved by the competent courts of that country, subject to any mandatory consumer jurisdiction rules.
The EU provides an Online Dispute Resolution platform as an alternative to court proceedings. We are not required to, and do not, participate in alternative dispute-resolution schemes before consumer-protection arbitration bodies.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date shows when they last changed. Changes take effect when posted; orders placed before a change are governed by the Terms in effect at that time.
